Terms & Conditions
The terms on which UnitedTech (Pty) Ltd provides connectivity, communications and client portal services. Please read them before using our services.
These terms form the agreement between you (the "Client") and UnitedTech (Pty) Ltd ("UnitedTech", "we") for the supply of our services — internet connectivity (fibre, licensed wireless, LTE and satellite), voice and phone systems (including NexysPBX and SIP trunking), reporting services, the UnitedTech client portal, and related support. Where you have signed a separate written agreement with us, that agreement prevails where it conflicts with these terms.
1. Services and orders
All services are supplied on a quoted basis. Quotations are valid for 30 days unless stated otherwise, and an order becomes binding when you accept our quotation in writing, electronically, or by instructing us to proceed. Installation timeframes are estimates given in good faith and depend on third-party networks, access to your premises and municipal or landlord approvals. Where we host or subscribe to network capacity from upstream providers, their availability forms part of our supply to you.
2. Fees and payment
Unless your quotation or invoice states otherwise: monthly recurring fees are billed in advance, usage and call charges are billed in arrears, and all amounts exclude VAT, which is added where applicable. Invoices are payable within 14 days of the invoice date. We may charge interest on overdue amounts at 2% per month, and may suspend services after written notice if an account remains unpaid for 30 days beyond terms. Reconnection after suspension for non-payment may attract a reasonable reconnection fee. Deposit and prepayment requirements, where applied, are stated in your quotation. Billing corrections and refunds are handled under our Refund Policy.
3. Term and termination
Services run month-to-month unless a fixed term is agreed in your quotation or a signed order. Either party may terminate a month-to-month service on 30 days written notice. Fixed-term agreements terminate on expiry unless renewed; early termination of a fixed term is payable as the balance of the remaining monthly fees, unless the agreement states otherwise. On termination you must return any rented UnitedTech equipment in good working order, reasonable wear and tear excepted. Number porting away from our voice services is done on your written instruction and may take up to 10 working days depending on the gaining provider.
4. Client responsibilities
- Provide safe access to premises, and lawful use of all services
- Maintain your own local network, cabling, power and customer-premises equipment, except where supplied and managed by us
- Keep account credentials for the client portal confidential; portal users act on your authority
- Ensure your use complies with our Acceptable Use Policy
5. Service levels and support
We provide a 24/7 South African support desk for fault reporting. Faults are prioritised by severity: service-down faults are attended continuously until restored; other faults are handled within reasonable support windows. Wireless, LTE and satellite services are provided on a best-effort basis dependent on radio conditions, terrain, weather and coverage; speeds quoted are maximum attainable and are not guaranteed minimums. Managed and uncapped services are subject to our Fair Usage Policy. Planned maintenance is published on our Network Notices page and in the client portal.
6. Equipment
Equipment may be bought outright, rented, or included in a monthly service as agreed in your quotation. Bought equipment carries the original manufacturer warranty; rented or included equipment remains our property and we maintain it at our cost unless damage results from misuse, lightning, power surges or negligence on your side.
7. Suspension and variance
We may suspend or vary a service where required by law, by our upstream providers, or for emergency network protection. We will give as much notice as circumstances allow, using the client portal, notices page, email or SMS. Where a variance materially reduces the service you pay for for more than 48 continuous hours, you may claim a pro-rata credit for the affected period.
8. Liability
Neither party is liable to the other for indirect or consequential loss, including loss of profit, revenue or data. Our total aggregate liability under or in connection with the services is limited to the monthly fees paid by you for the affected service in the three months preceding the claim. Nothing in these terms limits liability for death, personal injury or fraud.
9. Privacy
We process personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). How we collect, use and protect your information is set out in our Privacy Policy. Client portal data is stored on secured infrastructure and access is limited to authorised personnel.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified at least 30 days in advance via the client portal, the Network Notices page, email or SMS. Continued use of the services after the effective date of a change constitutes acceptance of the updated terms.
11. General and governing law
These terms are governed by the laws of South Africa and the courts of South Africa have jurisdiction. If any provision is found unenforceable, the remainder stays in force. We may not assign this agreement without notifying you; you may not assign it without our written consent. Notices to us may be sent to clientservices@unitedtech.co.za or 010 110 7100. E&OE.
12. Your statutory rights
Nothing in these terms excludes or limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 where those Acts apply to you, including the statutory cooling-off rights described in our Refund Policy and the disclosures published under ECT Act Information. Use of the services is subject to our Acceptable Use Policy and Fair Usage Policy, which form part of this agreement.
